Terms of Service

1. Platform Description

GetScoopr is an online directory and marketplace that connects homeowners and property managers ("Customers") with independent pooper scooper service providers ("Scoopers"). GetScoopr provides a platform for listing, discovering, and booking pet waste removal services. GetScoopr does not itself provide pet waste removal or any other physical service.

2. No Employment Relationship

Scoopers listed on GetScoopr are independent service providers. They are not employees, agents, joint venturers, or contractors of GetScoopr. GetScoopr does not control when, where, or how Scoopers perform their services. GetScoopr does not set pricing, schedules, or service standards for Scoopers. The relationship between a Customer and a Scooper is solely between those parties.

3. User Accounts

• You must be at least 18 years of age to create an account on GetScoopr.
• You are responsible for maintaining the security and confidentiality of your account credentials.
• You agree to provide accurate, current, and complete information during registration and to keep your profile information up to date.
• You are responsible for all activity that occurs under your account.
• Minors may participate in services only under the direct supervision of a registered adult, as outlined in our Minors & Supervision Policy.

4. User Responsibilities

All users are solely responsible for:

• Negotiating and agreeing upon pricing, scope of work, and service schedules
• Ensuring safe property access and providing accurate service addresses
• Handling payments between Customer and Scooper as facilitated by the platform
• Resolving any disputes that arise between parties
• Complying with all applicable local, state, and federal laws
• Maintaining appropriate insurance or liability coverage for their activities

5. No Service Guarantee

GetScoopr does not guarantee the quality, reliability, safety, timeliness, or legality of any services provided by Scoopers. GetScoopr does not perform background checks, verify credentials, or inspect the work of service providers unless explicitly stated otherwise. Customers engage Scoopers at their own risk and should perform their own due diligence.

6. Limitation of Liability

To the fullest extent permitted by law, GetScoopr and its owners, officers, employees, and affiliates shall not be liable for any:

• Property damage, loss, or theft occurring during or as a result of services
• Injury to persons or animals
• Pet escapes, gate/fence issues, or property access incidents
• Missed or incomplete service appointments
• Disputes between Customers and Scoopers
• Financial losses arising from use of the platform
• Indirect, incidental, consequential, or punitive damages of any kind

The platform and all services are provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

7. Payments

Payments facilitated through the platform are processed by Stripe. GetScoopr may charge a platform fee on transactions. By using the payment features, you agree to Stripe's terms of service. GetScoopr is not responsible for payment processing errors, chargebacks, or disputes handled by Stripe.

8. Prohibited Conduct

You agree not to:

• Use the platform for any unlawful purpose
• Harass, threaten, or abuse other users
• Provide false or misleading information in your profile or listings
• Circumvent platform payment systems to avoid fees
• Scrape, copy, or reproduce platform content without permission
• Interfere with or disrupt the platform or its infrastructure
• Create multiple accounts or impersonate another person
• Use the platform to send spam or unsolicited communications

9. Intellectual Property

All content, logos, trademarks, and design elements of the GetScoopr platform are the property of GetScoopr and are protected by applicable intellectual property laws. Users retain ownership of content they submit (such as profile information, photos, and reviews) but grant GetScoopr a non-exclusive, royalty-free license to use, display, and distribute such content in connection with operating the platform.

10. Termination

GetScoopr reserves the right to suspend or terminate any user account at its sole discretion, with or without notice, for any reason including but not limited to violation of these Terms, fraudulent activity, or conduct harmful to other users or the platform. Upon termination, your right to use the platform ceases immediately.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or related to these Terms or your use of the platform shall be brought exclusively in the state or federal courts located in Utah. You consent to the personal jurisdiction of such courts.

12. Dispute Resolution

Before pursuing any legal action, you agree to first attempt to resolve any dispute informally by contacting us through our Contact page. We will attempt to resolve the dispute within 30 days. If informal resolution is not successful, either party may pursue legal remedies as described in Section 11.

13. Indemnification

You agree to indemnify, defend, and hold harmless GetScoopr and its owners, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising from your use of the platform, your violation of these Terms, or your violation of any rights of a third party.

14. Modification of Terms

GetScoopr may modify these Terms at any time. We will post the revised Terms on this page with an updated "Last updated" date. Your continued use of the platform after any changes constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the platform.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Minors & Supervision Policy, and Affiliate Disclosure, constitute the entire agreement between you and GetScoopr regarding your use of the platform.
